ADULT ADOPTION

Adopting an adult is different from adopting a child. When a person is an adult, his or her parents no longer have "parental rights" relating to their offspring, and the biological parents no longer have a legal requirement to support, to take care of, or to visit him or her.
Therefore, in an adult adoption, the consent of the adoptee's biological parents is unnecessary. When a married person adopts a child in Texas, that person's spouse must join in the adoption and become an adoptive parent, too. When an adult is adopted, it is not necessary for both spouses to adopt. For example, a woman may choose to adopt another adult by herself, without her husband joining in the adoption and becoming an adoptive dad himself.
An adult adoptee may choose to change his or her name to match that of the adoptive parent(s).

If the purpose is unlawful, or "against public policy", the adoption will be denied. For instance, if the adoptee is attempting to use the adoption and name change to "disappear" from certain obligations or defraud someone, it will not be granted.
It is important to realize that adult adoptions do not give immigration benefits to the adopted person. In general, an adoption must be finalized prior to a child's 16th birthday in order for U.S. immigration benefits to apply. (although there is one exception in which the adoption may be completed before the child's 18th birthday).
