Hidden Assets & Marital Fraud

Divorce Cases Involving Hidden Assets or Marital Fraud

When you suspect that your spouse has hidden assets or otherwise committed marital fraud with respect to your finances, you need to take extra care during divorce proceedings to protect your own financial future.

Since 1984, the Kalish Law Firm has represented spouses in complex, high-conflict divorce cases. Our team of attorneys includes divorce lawyers who have decades of experience working with financial experts to track down hidden assets, to combat marital fraud, to develop asset protection strategies, and to defend clients against untrue accusations regarding hidden assets or marital fraud.

Don't Leave Your Marriage With Fewer Assets Than You Are Entitled To: Our attorneys will help you complete a cost-benefit analysis if you suspect your spouse has hidden assets that should be part of the marital estate. What is the potential worth of the assets compared to the cost of tracing and locating them? Our attorneys' goal is the same as yours: you should leave your marriage with as strong an asset base as possible.

If you are contemplating divorce and have suspicions or questions about hidden assets, division of property or marital fraud, contact the Kalish Law Firm to make an appointment with one of our lawyers.

Signs of Hidden Assets and Strategies to Find and Value Hidden Assets

In many marriages, one spouse takes primary responsibility for the couple's finances. If the marriage ends, however, that set-up can be a disadvantage to the spouse who did not have control over the marital finances. One spouse may be missing critical information about assets and debts accrued during the marriage. We need a full picture of the marital assets to best negotiate a marital settlement agreement under Texas' equitable distribution laws. Questions we ask include:

  • Do you have access to all joint bank accounts? Does your spouse have separate bank accounts? Do you?
  • Do you have information about your spouse's retirement funds? Do you know whether your spouse has more than one retirement plan?
  • What is your investment portfolio? Who is your investment adviser?
  • Do you suspect that your spouse owns assets or property in another state or country?
  • Has your spouse opened joint accounts but refused to give you access?
  • Has your spouse used joint credit cards to purchase tangible assets like gold or currency?

The Cost of Hidden Assets: If investigation determines that a spouse has intentionally hidden marital assets or diminished the marital estate — for the purpose of decreasing the assets awarded to the other spouse — then the court may order an inequitable distribution of the marital estate or may order the spouse to pay the other spouse's costs and legal fees associated with tracing the assets.

At the Kalish Law Firm, we work with investigators and forensic accountants to investigate hidden assets in cases of marital fraud. We have decades of experience tracing domestic and foreign assets of all kinds, including real estate, currency, retirement funds and bank accounts.
